Seawall

On May 21, 2021, the Circuit Court of the 20th Judicial Circuit in and for Collier County ruled that the City of Naples owns and bears the obligation to maintain the seawalls along Gulf Shore Boulevard North right of way, which was dedicated, by plat, to Collier County and later the City of Naples.  Specific areas of seawall ownership include approximately 3,300 linear feet of seawall abutting Outlots A through F, including Parcel C.  

On May 19, 2021, the City entered into a Settlement Agreement that, among other things, releases all parties from claims, disputes, etc. related to the seawall litigation, except in the case of a catastrophic failure of the existing bulging seawall at the property adjacent to the Venetian Bay North Yacht Club.  

The effort of this Phase I response to seawall repairs has primarily been focused on the bulging seawall at this location in Outlot “E”, with a cursory review of the remaining seawall areas. In June 2021, the Department retained a Coastal Engineering Consultants to lead in the development of seawall repair/replacement options for Outlot E, with the potential of applying the recommendations to other seawall segments along the 3,300 linear feet that the City is responsible for. Items under consideration in designing a solution that served all interested parties included an innovative concept for a seawall replacement project that provides similar connectivity to the shoreline, environmental benefits, and resiliency to sea level rise. Direction was received at the November 15, 2021 City Council meeting to Negotiate with Coastal Engineering to develop a scope of work, and fee and accelerated schedule to take Concept 3, for the entire 700’ length of Outlot “E” through to final design, permitting and bidding and bring back a task order for City Council to review and approve. Expanded scope with fee was approved by City Council on January 24, 2022, Project advertised for public bid on June 29, 2022 and contact for construction was awarded to Kelly Brothers, Inc. by City Council on September 7, 2022 in the amount of $2,099.995.31, which includes a $50,000 City controlled contingency.

To assist with construction cost, on July 12, 2022, the City applied for a Local Support Grant in the amount of $750,000 which Representative Rommel has agreed to sponsor with a deadline for award of September 15, 2022. Any funding received will be used for construction cost associated with the Gulf Shore Boulevard North Outlot “E” Seawall Replacement Project. On September 9, 2022 the City of Naples was notified the Legislative Budget Commission approved funding for this project in the amount of $375,000

The Seawall project is currently in the beginning stages and the construction schedule is still to be determined.
