PROJECTS UTILIZING ALTERNATIVE PLANS REVIEW AND INSPECTION SERVICES AS AUTHORIZED BY FLORIDA STATUTE 553.791
Note that the following shall be required in accordance with the governing statutes and codes and City Policy on all Private Provider Projects:
- In accordance with 553.791(2b),f.s. owners who have selected to use private providers for inspection services shall not be charged the $35 for each required inspection upon issuance of the permit.
- In accordance with 553.791(2)(a), owners who have selected to use private plan review will also need to select private provider inspections. If private review is selected, the Building Code plan review fee will not be charged, and an additional 15% of the base permit fee will be subtracted to cover costs with inspections not covered in the base inspection fee of $35 per inspection also credited for using private inspections.
- Per City policy, additional permit applications at a property with an open private provider review/inspection permit will be issued with private provider review/inspection, to avoid gaps or conflicts in responsibility. To further clarify, a project can either go city review/inspections or can choose private review/inspections but not both. A project is defined as all work proposed, including any accessory permits required in addition to the main (new or addition/alteration) permit. Any other arrangement must be requested in writing by the property owner and approved by the Building Official.
- The 20-business day review period required by 553.791(7a, b,c,d) f.s. and 10 business day period per 553.791(10) f.s. shall not include plan review time required by other departments for local ordinance compliance. These include City Utility Department Plan Review, City Flood Plain Ordinance Plan Review, City Planning Department Review, City Streets & Storm Water Department Review, and City R.O.W. Plan Review.
- In accordance with 553.791(9), f.s. a private provider performing required inspections under this section shall provide notice to the local building official of the approximate date and time of any building code inspection no later than the prior business day by 2 p.m.

In the email SUBJECT list:
1) Permit number, 2) Address, 3) Date/Time, and Inspection code description.
EXAMPLE: 159999, 123 Smith Street S., 4/7/18 @ 2pm, 124 Slabs
Do not include anything in the body of the message; only the subject will be viewed.
There may not be a response to these emails.
- In accordance with 553.791(12),f.s. upon completing the required inspections the private provider shall post each completed inspection record at the project site or electronically on private provider’s website and provide all such inspection records to the Building Official with the private provider’s Certificate of Compliance upon completion of the project. Records of all required and completed inspections shall be maintained at the building site at all times, or electronically posted, and made available for review by the local Building Official. The private provider shall report to the local enforcement agency any condition that poses an immediate threat to public safety and welfare.
- In accordance with 713.135(1)(e),f.s. prior to the first inspection a certified copy of the recorded Notice of Commencement must be provided to the building department.
- In accordance with FBC 110.3 A Spot Elevation Certification shall be provided to the Building Official after placement of the lowest floor, prior to further vertical construction.
- Building Department policy, a Spot Site Survey shall be provided for Planning and Zoning review after placement of the lowest floor, prior to further vertical construction.
Non-compliance with the above policies may result in a stop work order issued by the Building Official.
TCO Requests for Private Provider inspected projects
Before a TCO request can be considered on a Private Provider inspected project, all fees must be paid in full, including impact fees. The project must have all final inspections either approved or partially approved on all permits associated with the project (pools, generators, shutters, fences, accessory buildings, site work, etc.). Final inspections are roof 399, electric 499, pool 599, mechanical 699, plumbing 799, and building 199. If an inspection has a partial pass status, the inspector must note what is missing or needs correction and that it is safe for occupancy without limitations. Request letter must list all associated permits along with each permit’s status.
TCO requests must be sent via email to the TCO/CO request email TCO-COREQUEST [at] NAPLESGOV.COM (TCO-COREQUEST[at]NAPLESGOV[dot]COM) and copied to the building official and deputy building official.
If any final Private Provider inspections are not fully approved, include the preliminary TCO Request Private Provider Certificate of Compliance package in the TCO request email.
DO NOT UPLOAD PRELIMINARY TCO REQUEST COMPLIANCE PACKAGES TO THE PERMIT. COMPLIANCE PACKAGES UPLOADED FOR TCO REQUESTS THAT ARE NOT COMPLETE WILL BE FAILED FOR INCOMPLETENESS AND A RE-REVIEW FEE WILL BE CHARGED.
Preliminary TCO Request Private Provider Certificate of Compliance package includes the TCO Certificate of Compliance affidavit, clearly labeled as for TCO, and all inspection reports. The TCO Certificate of Compliance affidavit shall state: “To the best of my knowledge and belief, the building components and site improvements outlined herein and inspected under my authority have been completed in conformance with the approved plans and the applicable codes, with the exception of the following items…” which must list what is outstanding and the expected time to complete. The TCO Certificate of Compliance shall also state that the property that is the subject of the identified permit(s) is safe for occupancy without limitations.
All permit inspection reports (which shall reflect those inspections required by the applicable codes of each phase of construction for which permitting by the local agency is required) must be provided.
If all final Private Provider inspections are complete and approved at the time of TCO request, upload the final Private Provider Certificate of Compliance package to the permit condition rather than including with the TCO request email.
Once the TCO request is received it will be reviewed by the city and a response will be rendered when done. There is no time limit on this review, but it will be done as soon as staff time allows. Please allow at least 72 hours for single family projects and 5 days for multi-family, mixed use and commercial projects. City reviews for TCO’s will involve other city departments as deemed appropriate by the building official. In most cases a decision will be made well before that time. If 72 hours (single family) or 5 days (all others) and no response has been provided, the applicant can call to inquire. Calls to inquire within the above-mentioned period will not be returned.
CO Requests
If a preliminary TCO compliance package was submitted for TCO, upload the final Private Provider Certificate of Compliance package to the permit condition when project is complete.
Email request for CO to the TCO/CO request email TCO-COREQUEST [at] NAPLESGOV.COM (TCO-COREQUEST[at]NAPLESGOV[dot]COM) once the project is 100% complete including all associated separate permits (pool, generator, shutters, fence-walls, ROW, etc.) and all requirements for Flood, Planning, Fire, Stormwater, Utilities, etc. are met. In certain circumstances it may be possible to CO a building separately, but these will be considered on a case-by-case basis, and will be the exception and rare, and will only be considered upon a strong hardship and not out of convenience, and documentation of hardship will be required. If an exception is made, a completed and approved Elevation Certificate, Final Survey at minimum will be required that can be reviewed and approved by all departments for all permits that require these documents.
Statutory requirements and time frames apply for CO requests, and no calls to inquire on status will be returned during that time frame.
