Flood Mitigation Guidelines & Regulations for Property Owners

The City of Naples is committed to educating and assisting property owners in their efforts to enhance resiliency against flooding. Following recent hurricanes that brought substantial water intrusion and damage, many property owners have explored floodproofing measures, including flood panels. 

The City of Naples is allowing the use of flood panels to mitigate flood risk on existing residential buildings. Published guidance that has been vetted and approved by the State of Florida Department of Emergency Management Office of Floodplain Management (FDEM OFM) is provided below. This page outlines the City’s position, regulations, and permitting requirements for flood mitigation methods to existing residential and non-residential structures.

Key Considerations for Flood Mitigation

City’s Participation in the National Flood Insurance Program (NFIP)
  • The City of Naples is a voluntary participant in the NFIP, allowing property owners access to federally backed flood insurance.
  • Compliance with NFIP regulations and the Florida Building Code is required to maintain participation and avoid jeopardizing access to flood insurance for all City property owners.
  • Both Florida Building Code and NFIP regulations treat residential and non-residential buildings differently, particularly regarding their design in the Special Flood Hazard Area (SFHA).
    • Currently, over 90 percent of the addresses within the City of Naples are within the SFHA; therefore, subject to additional scrutiny related to the design and use of space below the FEMA-provided Base Flood Elevation (BFE).
  • FEMA requires all flood-related building modifications to comply with regulations.
  • Voluntary installation of flood panels does not necessarily bring an existing building into flood compliance and may affect flood and homeowner insurance.
  • If unpermitted work is performed, the City of Naples risks suspension from the NFIP, which could lead to:
    • Loss of flood insurance discounts for all city residents.
    • Potential inability for property owners to obtain flood insurance.

Voluntary Use of Flood Panels

Use of flood panels to mitigate flood risk is a voluntary action not meant to achieve code compliance and can be allowed, provided the following conditions are met:

  1. The installation of the panels cannot make the building less safe and must maintain the required means of egress.
  2. The building can support all flood loads that will be imposed on it when the panels are deployed to the proposed FPL (Flood Protection Level).
  3. The installation of flood panels cannot create a non-conformity out of a building that was built in conformance with the building and flood code requirements at the time of original construction.
  4. All combined work being done does not constitute a substantial improvement (exceed 50% actual cash value of the building/50% rule).
  5. The work is authorized with a permit, and permit records are maintained by the building department.
