Homestead Exemptions for Totally and Permanently Disabled First Responders: Removes limitation requiring disabilities caused by cardiac events to meet certain requirements. Effective Date: July 1, 2024
SB 0616 Tax Exemptions for Surviving Spouses of Quadriplegics by Simon
FLC – OPPOSE
Tax Exemptions for Surviving Spouses of Quadriplegics; Authorizing the surviving spouses of certain quadriplegics to carry over a certain tax exemption in certain circumstances, etc. Effective Date: On the effective date of the amendment to the State Constitution proposed by SJR 618, or a similar joint resolution having substantially the same specific intent and purpose, if such amendment is approved at the next general election or at an earlier special election specifically authorized by law for that purpose.

SB 0280 Vacation Rentals by DiCeglie

(This bill does not apply to the City of Naples. It is applicable to communities with short term rental registration programs. It reinforces status quo for us because it maintains the grandfather for ordinances adopted prior to June 1, 2011)

Vacation Rentals; Requiring advertising platforms to collect and remit specified taxes for certain vacation rental transactions; defining the term “advertising platform”; adding licensing to the regulated activities of public lodging establishments and public food service establishments which are preempted to the state; requiring advertising platforms to require that persons placing advertisements or listings for vacation rentals include certain information in the advertisements or listings and attest to certain information; authorizing the division to revoke, refuse to issue or renew, or suspend vacation rental licenses under certain circumstances, etc. Effective Date: Except as otherwise expressly provided in this act, this act shall take effect July 1, 2024.
SB 0328 Affordable Housing by Calatayud
Affordable Housing; Prohibiting counties and municipalities, respectively, from restricting the floor area ratio of certain proposed developments under certain circumstances; authorizing counties and municipalities, respectively, to restrict the height of proposed developments under certain circumstances; requiring counties and municipalities, respectively, to consider reducing parking requirements under certain circumstances; revising conditions for when multifamily projects are considered property used for a charitable purpose and are eligible to receive an ad valorem property tax exemption, etc. APPROPRIATION: $100,000,000 Effective Date: Upon becoming a law

Affordable Housing: Provides and revises provisions related to affordable housing, including multifamily & mixed-use residential development uses, floor area ratio of certain proposed developments, restrictions of height of certain proposed developments, development within specified proximity to military installations, ad valorem property tax exemptions, property appraisers duties, property owners seeking certification notice from Florida Housing Finance Corporation, requirements for market value analysis, & exclusion of certain proposed developments from specified airport zoning provisions. Effective Date: upon becoming a law.

Investigation of Complaints Against Law Enforcement and Correctional Officers; Revising the definition of “political subdivision”; prohibiting a political subdivision from adopting or attempting to enforce certain ordinances relating to the receipt, processing, or investigation of complaints against law enforcement officers or correctional officers, or relating to civilian oversight of law enforcement agency investigations of complaints of misconduct by such officers, etc. Effective Date: 7/1/2024

Cybersecurity Incident Liability; Providing that a county, municipality, commercial entity, or third-party agent that complies with certain requirements is not liable in connection with a cybersecurity incident; requiring certain entities to adopt certain revised frameworks or standards within a specified time period; specifying that the defendant in certain actions has a certain burden of proof, etc. Effective Date: Upon becoming a law.

SB 0688 Alternative Mobility Funding Systems by Martin

Alternative Mobility Funding Systems; Authorizing certain local governments to adopt an alternative mobility planning and fee system or an alternative system in certain circumstances; prohibiting an alternative system from imposing responsibility for funding an existing transportation deficiency upon new development; providing that only local governments issuing building permits may charge for transportation impacts; revising requirements for the calculation of impact fees by certain local governments and special districts, etc. Effective Date: 7/1/2024
HB 0479 Alternative Mobility Funding Systems by Robinson (W) Jr.

Alternative Mobility Funding Systems: Revises requirements relating to agreements to pay for or construct certain improvements; authorizes local governments to adopt alternative mobility planning & fee system; prohibits alternative system from imposing responsibility for funding existing transportation deficiency on new development; prohibits local governments that do not issue building permits from charging for transportation impacts; prohibits local governments from assessing multiple charges for same transportation impact; revises requirements for calculation of impact fees; requires local governments transitioning to alternative funding systems to provide holders of impact fee credits with full benefit of intensity & density of prepaid credit balances as of specified date. Effective Date: July 1, 2024.

Land Use and Development Regulations: Revises mechanisms by which owners of agricultural lands apply for & are granted rezonings; revises requirements for use by local governments in reviewing applications for agricultural enclaves; revises types of data that comprehensive plans & plan amendments must be based on; revises means by which application of methodology used in data collection or whether particular methodology is professionally accepted & evaluated; revises criteria for adopting small scale development amendment; revises content requirements for local land development regulations; revises mechanisms by which applications for infill development must be administratively approved. Effective Date: July 1, 2024

Complaints Against Law Enforcement and Correctional Officers
(Oppose – as it would be in conflict with FSS 112. as well as the concept of procedure justice)
HB 601 (Duggan) and SB 576 (Ingoglia) make it unlawful for municipalities or citizen oversight boards to pass or enforce any ordinance relating to the receipt, processing or investigation of complaints of misconduct by law enforcement officers and correctional officers. The bills also prohibit the creation of any laws in relation to civilian oversight of a law enforcement agency in relation to the investigation of complaints. (Wagoner)
Cold Case Murders
(Monitor- could become another unfunded mandate)
SB 350 (Osgood) and HB 837 (Benjamin) address cold case murders by establishing a process for reviewing and reinvestigating such cases. The bills mandate that law enforcement agencies review cold cases upon receiving a written application from a designated person and outlines the criteria for conducting a full reinvestigation, including the identification of new probative leads or a likely perpetrator. The bills require law enforcement agencies to develop a written application for cold case reviews and mandate training for employees on the procedures and requirements outlined in the bill. Page steThe bills also require law enforcement agencies to report quarterly all relevant data to the Global Forensic and Justice Center at Florida International University. The bills direct the Center to establish a case tracking system and searchable public website. The bills also allow medical examiners to issue death certificates with nonspecific causes of death and manner of murder under certain conditions. (Wagoner)
Exposures of First Responders to Fentanyl and Fentanyl Analogs
(Support – charging enhancements)
HB 231 (Baker) and SB 718 (Collins) provide criminal penalties for persons who unlawfully and intentionally possess and expose first responders who are acting in their official capacity to Fentanyl and Fentanyl Analogs. (Wagoner)
Storage of Firearms in Private Conveyances and Vessels
(Monitor – positive but another unfunded mandate)
HB 419 (Hinson) prohibits the storage of firearms in unoccupied private conveyances and vessels unless the firearm is kept from ordinary view and locked within a trunk, utility or glove box, or another locked container, or secured with a device or mechanism that is securely affixed to the private conveyance or vessel. The bill requires local law enforcement agencies to engage in a promotional campaign to educate the public and gun owners about the requirements above. (Wagoner)
Possession or Use of a Firearm in a Sensitive Location
(Support – a security enhancement)
SB 130 (Berman) and HB 209 (Rayner) would prohibit the possession or use of a firearm in “sensitive locations.” The bills define a sensitive location as numerous public facilities including but not limited to buildings or facilities owned, leased or operated by government entities, including public transportation.
